Terms & Conditions
Article 1. Applicability
1.1 These General Terms & Conditions apply to all paardenmelk.be offers, orders and contracts.
1.2 Accepting an offer and placing an order means that you accept the applicability of our Terms & Conditions.
1.3 These Terms & Conditions may only be deviated from if this is confirmed in writing. In this event, the remaining stipulations shall remain applicable in full.
Artikel 2. Offers/contracts
2.1 All offers of paardenmelk.be are without obligation and paardenmelk.be expressly retains the right to change prices, in particular if this is necessary due to (legal) requirements. Also see Article 3.6.
2.2 A contract can only come into being following acceptance of your order by paardenmelk.be. Paardenmelk.be is entitled to refuse orders or to attach certain conditions to the delivery, unless expressly determined otherwise. If an order is not accepted, paardenmelk.be shall inform the customer of this within ten (10) working days of receipt of the order.
Article 3. Prices and payments
3.1 The prices given for the products and services offered are in Euros, including VAT and excluding postage and handling charges and any taxes or other charges, unless stated otherwise or agreed otherwise in writing.
3.2 Payment shall occur without discount or compensation within fourteen (14) days of the date of invoice.
3.3 Payment may occur in advance via bank transfer or via credit card (PayPal). In the event of payment via the bank, the date of payment is the date paardenmelk.be’s account is credited with the amount.
3.4 If this term of payment is exceeded, you shall be in default from the day on which payment should have occurred and shall owe 1 % default interest per month or part thereof on the outstanding amount. If payment occurs following a reminder by paardenmelk.be you shall owe an amount of twenty-five euros (€ 25.00) for administration costs and if paardenmelk.be passes its claims on to a debt-collection agency, you shall also owe debt-collection costs, which shall be a minimum of fifteen per cent (15%) of the outstanding amount, without prejudice to the entitlement of paardenmelk.be to claim the actually incurred non-legal debt-collection costs.
3.5 If you remain in default of any payment, paardenmelk.be shall be entitled to postpone (fulfillment of) the contract in question and any connected contracts or to annul them.
3.6 If the prices for the products and services offered increase in the period between placing the order and its fulfillment, you shall be legally entitled to cancel the order or to annul the contract within ten (10) days of communication of the price increase by paardenmelk.be.
Article 4. Delivery
4.1 The delivery times given by paardenmelk.be are indicative only. The exceeding of any delivery time shall not entitle you to compensation or to cancel your order or to annul the contract. Unless the exceeding of the delivery time is such that you cannot be reasonably expected to leave the contract in place. In that case you shall be legally entitled to cancel the order or to annul the contract, if necessary.
4.2 Delivery of the products shall occur at the place and time at which the products are ready to be sent to you.
Article 5. Right of ownership
5.1 Ownership of the delivered products shall only pass to you if you have paid everything owed by you to paardenmelk.be on the basis of any contract. The risk relating to the products shall already pass to you the moment they are delivered to you.
Article 6. Complaints and liability
6.1 Upon delivery you are obliged to check that the products comply with the contract. If that is not the case, you shall inform paardenmelk.be of this as quickly as possible and certainly within seven (7) working days of delivery, or at least of it being reasonably possible to establish this, in writing/by email and stating the reason.
6.2 If it is shown that the products do not comply with the contract, paardenmelk.be shall have the choice, following their return, of replacing the products with new products or of refunding the invoice amount.
6.3 If, for whatever reason, you do not wish to buy a product you have the right, as a private individual, to return the product within seven (7) working days of delivery to paardenmelk.be. In this event, return shipments shall only be accepted if the product’s packaging is undamaged and the cost of returning the product shall be borne by you.
Article 7. Guarantee
Complaints relating to externally visible defects shall, in accordance with the conditions of the contract, be submitted in writing within maximum seven (7) days of receipt of the goods by the customer. Paardenmelk.be shall not be obliged to deal with complaints received by paardenmelk.be after this period has passed.
